What status should fit instead
The target basis needs to be identified before a procedure is named. The useful question is what legal status should correctly describe the person’s present circumstances.
Whether a qualifying conversion is available
Not every mismatch can be corrected through the same mechanism. We review whether a qualifying change or conversion of residence status is available for the facts in question.
