The correct family process depends on when the family applies, the principal applicant’s status and nationality, and whether the move is temporary or for residence.
Do not automatically place every family into post-residence family reunification. The timing of the move can change the legal framework.

Family Accompaniment — Residence Visa

Where the principal applicant is still applying for a Portuguese residence visa, qualifying family members may be able to apply to accompany them at the residence-visa stage. This is legally different from Article 98 family reunification after the sponsor already holds residence.

Family Reunification — Resident Sponsor

Where the sponsor already holds a Portuguese residence permit, Article 98 family reunification becomes the relevant framework. The 2025 amendments introduced residence-period rules with important statutory exceptions.

  • The general waiting-period rule is not universal.
  • Sponsor status and the family relationship must be analysed together.
  • Highly qualified, ARI and EU Blue Card families can receive specific statutory treatment.

Temporary Stay — Family Accompaniment

A qualifying family member can have a separate accompaniment basis where the principal person holds a Temporary Stay Visa, except where the principal temporary-stay visa is for seasonal work.

EU citizen / EU family framework

EU citizens and their qualifying family members use the separate free-movement framework under Law 37/2006 rather than the ordinary national family-reunification rules where EU-law conditions are met.

Does my spouse always need to wait after I move?

No. The answer depends on the principal route, whether the family is still at the residence-visa stage, the sponsor’s later status and any statutory exception.

Is Article 98 the only family route?

No. Family accompaniment at the residence-visa stage, temporary-stay accompaniment and the EU-family framework are distinct legal mechanisms.
